Greater Shepparton City Council at its Ordinary Council Meeting held last night, resolved that Council would have refused the Application to grant a permit for the use and development of 115 Stewart Road, Tatura for an animal keeping and breeding facility of 100 dogs, due to community and legislation concerns. A Section 79 appeal was lodged prior to the meeting, leaving Council unable to make a decision on the application.
The application had been publicly advertised and 62 objections were lodged. The key concerns raised in the objections were noise from barking dogs, devaluation of land, the treatment and smell of effluent, the number of dogs, stress on surrounding livestock, failure to comply with the Code of Practice for the Operation of Boarding Establishments and animal cruelty grounds.
“The level of detail provided in the application plans including the management of environmental impacts and risks were insufficient, leaving Council unable to properly assess the impacts of the proposal,” said Greater Shepparton City Council Mayor Cr Kim O’Keeffe.
“Amongst a number of concerns, the surrounding neighbours were most concerned about the potential amenity impacts of the proposal. The uncertainty of noise related issues in the absence of any detailed assessment did not achieve an acceptable planning outcome.
“A failure application to VCAT has been lodged and so the permit application will now be referred to VCAT,” said Cr O’Keeffe.
